Terms & Conditions of hire and sales

HIRE
1.       Duration
(a)     The period of hire shall commence on the date on which the goods are collected by or delivered to you.
(b)     The period of hire shall end on the earlier of the following days:
(i)  the day on which the goods are redelivered to us at the delivery point agreed, OR
(ii) the day on which the goods are collected by us from you at the delivery point agreed.

You shall in any event return the goods to us not later than the end of the period of hire.  Please read section '10 Deposits' for late returns.

2.       Payment
Payment of hire rent on or before taking delivery of the goods you shall pay to us the hire rent agreed.  If you chose to pay via Paypal cart or Paypal invoice, you automatcally agree to the terms and conditions of hire as listed on this page.  You also agree to accept the Paypal fees as listed per option or as per invoice.

3.       Defective goods
(a)    You must report any defects with the goods to us within 24 hours of delivery and you must, if so requested by us, return the goods to us for inspection. If we agree in our absolute discretion that the goods are defective, we shall use all reasonable endeavours (but shall not be bound) to provide a suitable replacement item or items, and shall 
credit you with such an amount not exceeding 2 days' hire rent as we shall in our absolute discretion consider appropriate.

(b)    Subject only to the above, we accept no responsibility for any loss, damage, costs, claims or expenses suffered or incurred by you or by    any third person (including the your servants or agents) to the full extent permitted by the law.

4.       Use
(a)    The goods shall be under your control at all times from delivery until redelivery, and you shall ensure that goods are used or positioned   safely and without risk to health and are not used for any purpose for which they are not designed or reasonably suitable.
(b)     The goods shall be used only at the location or venue agreed in advance with us.

5.       Indemnity
You shall be responsible for and shall indemnify us against all loss or damage caused to or by the goods from whatever cause arising.
     

6.       No sale etc 
(a)     You shall keep the goods in your sole possession and shall not lend the goods or sublet them to any person or otherwise part with possession of them in any way.

(b)     You acknowledge that the goods remain our property at all times and must not in any circumstances be sold or used as security.

7.       Repairs
(a)     You must not repair or attempt to repair the goods in the event of damage but must notify us as soon as is reasonably possible.

(b)     If the damage has been caused by the fault or carelessness of you or by misuse of the goods, the repair will be at your expense. In any other case, the repair will be at our expense.
(c)      Nothing in this clause shall render us liable to you for any resultant or consequential loss, damage or inconvenience.

8.       Termination
This agreement and the hiring constituted by it shall without notice but at our option end and you shall no longer be in possession of the goods with our consent, in any of the following circumstances:

(a)     a default by you in the payment of any money due under this agreement for a period of 7 days;
(b)     a breach by you of any of the provisions of this agreement other than those relating to the payment of money;
(c)      you presenting or allowing to be presented an application for an interim order or a petition for a bankruptcy order within the meaning of the Insolvency Act 1986 or allowing the levy of any distress or execution against you.

9.       Consumer Credit Act 1974
It is agreed and declared that this agreement falls outside the Consumer Credit Act 1974.

10.     Deposits
If bunting has not been received on the agreed return date for personal returns, and within 24 hours of the return date for postal returns, and you CANNOT provide proof of posting, any/all deposits will be cashed due to loss of hirings even if the bunting is received at a later date.  In some circumstances, you may also be expected to pay for same day delivery if the bunting is urgently required for the next booking.  Any bunting returned with damage, stains or markings making it in anyway un-usable or that require any repair will also result in loss of your full deposit.

11.     Cancellations
Cancellations made after booking confirmation (deposits received), anytime prior to your event, up to and including the event date itself, will result in the loss of your full deposit.  Hire and p&p payments will be refunded but any other non-hire expenses incurred will not.

12.     Proof of posting

Please obtain proof of posting when returning your bunting and when sending any cheques to Dilly Dally Bunting.

13.       Privacy Policy
Dilly Dally Bunting do not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party

14.       Special Offers (please refer to terms & conditions with offer)
Special offers only apply for the exact dates specified, and for the exact offer as stipulated in the description.  Normal deposit, post and packaging or any other fees as stated in your booking confirmation will apply unless stated otherwise.

15.       Quotations

16.       Alternative bunting
(due to late returns/damage on hiring etc)
We may occasionally have to offer alternative design/quantities of bunting at the time of your event, although this is avoided to the best of our ability.  We will inform you of this as soon as possible with details of alternative sets.  You will have the option to cancel your booking with a full refund.

17.       Changes in fees
We will and do have to occasionally change fees for hiring, deposits and postage to keep in line with other factors and associated companies.  We will make these changes fully visible on our website and inform any ‘pending’ bookings before payments are taken.  If you have already made a booking and deposits have been received before these changes take place, but your event is after the changes take effect, you will still pay the original fees, be they higher of lower and will therefore not be expected to pay extra, or will you receive a refund.

1.       Descriptions & Pictures

All bunting/other items fabrics and options are described and/or shown to the best of our ability.  If there are any changes after you have placed an order, we will inform you as soon as possible.

 

2.       Quotations

 Quotaions expire 30 days from the date created (this date is printed on the form)

 

3.       Confirmation of orders & invoices

Once orders have been placed, we will email you with confirmation of your order details and the full cost including any post and packing.  Our website for online payment is set up to run with 'Paypal' which will send you confirmation  of your of payment/sale items.

 

4.       Deposits (bespoke marquee bunting)

On placing an order, we will require a deposit of 25% of the quotation total.  This secures your order, and will not be refunded if you then chose to cancel as it is put towards the cost of materials.  The balance is required on delivery of your bunting.

 

5.       Cooling off period

We offer the 7 day 'cooling off'/cancellation period in line with the EU distance selling directive.  Personalised items (eg. items with initials or any personal design/colour schemes) cannot be cancelled or returned unless genuinely faulty.  If you chose to cancel your order, you must tell us in writing within the 7 days after placing your order.

 

6.       Dispatch

We dispatch items within 30 days from the day after you place your order.  We will send an email confirmation to tell you we have dispatched your items (we obtain proof of posting on items sent to you).

 

7.       Post & Packaging

Our website is set up to automatically work out postage based on the total weight of your basket (bar bunting hire which is a fixed rate per hire).  We post sale items out by Royal Mail 1st class packet if it is small enough, and standard parcel delivery otherwise.  We will email you when your items(s) have been dispatched.

 

8.       Proof of Posting

Please obtain proof of posting on all cheques sent to Dilly Dally Bunting.

 

9.       Privacy Policy

We post using Royal Mail 'guaranteed next day', but are happy to get quotes from other couriers if you prefer. Please let us know if you require postage, providing the delivery address to be sent to.
